Trial was held and at the close of the plaintiffs case, the defendants without presenting any testimony or evidence, announced that they rested and then moved for a Directed Verdict. The trial court granted defendants motions and instructed the jury to return a verdict in favor of both defendants. After the order was made denying plaintiffs motions to set aside the verdict, for Judgment N. O. V. and for a new trial, plaintiff brought this appeal.
